Conditions of Carriage

Last updated 26 October 2026.

These conditions apply when Kojora confirms a freight shipment. They are the contract for moving those goods. The Terms of Use still cover the website and tracking. The Privacy Policy explains personal information.

Sending the form on the website asks Kojora to contact you. A contract to carry goods begins when Kojora confirms that shipment. If a written confirmation for a job states a different price, route, time, or liability limit, that confirmation applies to that job, except where Nigerian law does not allow the difference.

Who these conditions bind

Kojora Group of Companies Limited (“Kojora”, “we”, and “us”) arranges freight delivery and provides shipment tracking at www.kojoragroup.com.

“You” means the person or business that asks Kojora to carry the goods and anyone who acts for them. You confirm that you own the goods or that you are allowed to send them on these conditions.

Kojora is the company you contract with for a confirmed shipment, including where a Kojora driver and vehicle perform the carriage. If the confirmation names a different carrier, that confirmation says so.

When a shipment is agreed

Kojora confirms a shipment by agreeing, in a message you can keep, the details needed for that job. Those details include:

  • what is being carried
  • where it will be collected and delivered
  • the price, or the way the price will be calculated
  • any timing that has been agreed
  • any insurance or liability limit that has been agreed

Kojora may refuse goods, a route, or a date. A conversation, a website visit, or a delivery request is not that confirmation.

Price and payment

You pay the price stated in the confirmation. If the confirmation says charges depend on weight, waiting time, or a change of address, those charges are part of the price once they are incurred and stated to you.

Payment is due as the confirmation states. If it does not state a time, payment is due before delivery unless Kojora has agreed credit. Kojora may wait to release the goods until the agreed charges for that shipment are paid, where the law allows a lien.

What you must tell us

Before collection, you must give Kojora an accurate account of:

  • the nature, quantity, weight, and value of the goods, where value matters to packing, insurance, or a liability limit
  • pickup and delivery addresses and a person who can be reached at each end
  • anything that makes the goods dangerous, fragile, perishable, unusually valuable, or subject to a permit
  • any deadline that is essential, so Kojora can say whether it can be met

Kojora relies on that account. A difference that affects safety, legality, the vehicle, the price, or the time can be a reason to refuse the goods, to adjust the price, or to cancel that shipment.

Other people’s details

If you give us a receiver’s or driver’s name and phone number, you confirm that you may share it and that you have told them Kojora will use it for this shipment. Our Privacy Policy describes that use.

Goods we do not carry

Unless Kojora agrees in writing before collection, we do not carry:

  • goods that are illegal to possess or to move in Nigeria
  • explosives, weapons, ammunition, and fireworks
  • flammable, corrosive, toxic, infectious, or radioactive material that was not declared and accepted
  • narcotics and other controlled drugs
  • currency, bearer cheques, and jewellery or precious metals sent as cargo
  • live animals and human remains
  • goods that require a licence or permit you have not obtained
  • perishable goods, unless the confirmation says they will be carried and on what conditions

Kojora may refuse a consignment it reasonably believes is in this list, and may tell the authorities where the law requires or where safety requires it. You remain responsible for the consequences of handing over goods you were not allowed to send.

Packing and loading

You pack the goods so they can withstand ordinary road transport. You provide the people and equipment needed to load and unload, unless the confirmation says Kojora will do that. Kojora may refuse goods that are packed in a way that makes them unsafe to carry.

Kojora does not open packages as a routine. Kojora may inspect or refuse a package where there is a reasonable concern about safety, legality, or a mismatch with what was declared.

Collection and delivery

Kojora collects and delivers at the places named in the confirmation. Delivery is made to the named receiver, or to a person at that address who appears authorised to receive the goods. A receiver confirmation code, or a delivery record made by operations, is evidence that delivery was recorded. You may show that the record is wrong.

If nobody is available to receive the goods, Kojora will contact you. Storage, a second delivery, or a return can be charged at the reasonable cost Kojora states at the time. Goods that cannot be delivered and are not collected after notice may be returned or dealt with as the law allows.

Timing

Collection and delivery times are estimates unless the confirmation states a binding time. Traffic, weather, road conditions, security, vehicle condition, and time spent waiting at either address affect the journey. Tell us before you confirm the shipment if a time is essential. If we cannot meet it, we will say so before we agree to carry.

Tracking

Tracking on the website shows the latest update on record. It may be delayed. It is not a statement that the vehicle is at the mapped point at the moment you look, and it is not a promise of the arrival time. The Terms of Use explain codes and preview shipments.

Loss, damage, and delay

Kojora takes reasonable care of the goods while they are in our charge for a confirmed shipment. Tell us about loss or damage as soon as you know about it. The claims section below says how.

Kojora is not liable for loss, damage, or delay caused by:

  • goods that were not allowed, or that were not correctly described
  • packing you provided that was not suitable
  • an act or omission of you, the receiver, or someone acting for either of you
  • the nature of the goods themselves, including ordinary leakage, evaporation, or wear from road transport where the goods were fit to send
  • an event outside our reasonable control, described below

Insurance

Kojora does not insure your goods unless the confirmation says, before collection, that insurance is arranged and states the cover. If the goods are valuable, fragile, or hard to replace, arrange your own insurance and tell us the declared value before the vehicle is sent.

Limit of liability

Nothing in these conditions limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability the laws of Nigeria do not allow us to limit or exclude. This includes rights the Federal Competition and Consumer Protection Act 2018 gives a consumer where that Act applies and does not allow a limit.

Subject to that:

  • Where loss of or damage to the goods is caused by our failure to take reasonable care, our liability is limited to the lower of the reasonable repair cost or the fair market value of the affected goods, and the freight charges you paid to Kojora for that shipment.
  • A higher limit applies only if it was agreed in writing before collection, or if insurance was agreed in the confirmation for a stated value.
  • Liability for delay, where the law requires it, is limited to the freight charges you paid to Kojora for that shipment.
  • We are not liable for indirect or consequential loss, including lost profit, a lost contract, or a fall in market price, where the law allows that exclusion.

The freight-charge limit is easy to miss, so it is stated here on purpose. If you need a higher limit, agree it before the goods are collected.

Claims

If damage is visible on delivery, tell the driver or Kojora before the goods are accepted, and follow with a written note. For other loss or damage, write to us within 7 days of delivery, or within 7 days of the date the goods should have been delivered if they are lost. Set out the claim, the shipment reference, and the amount within 30 days of that same date.

A late notice does not remove a right the law says cannot be waived. Delay can make the claim harder to investigate, and Kojora may reject a late claim where the law allows.

Please contact us before you start a formal complaint, so we can investigate. You may still complain to the Federal Competition and Consumer Protection Commission, or bring a claim in a court the law allows.

Cancellation

Before Kojora confirms the shipment, you can withdraw the request without a cancellation charge. After confirmation, you pay the cancellation or wasted-trip charges stated in that confirmation. If none were stated, you pay the reasonable costs Kojora has already incurred for that shipment, such as a vehicle that has already been sent.

Kojora may cancel a confirmed shipment if the goods differ from what was declared, if carriage would be unsafe or unlawful, or if an event outside our reasonable control makes the trip impracticable. If we cancel for a reason that is not your breach, we refund freight you have paid for the part of the job we did not perform.

Events outside reasonable control

Kojora is not liable for a failure or delay caused by something outside our reasonable control. That includes severe weather, a closed or unsafe road, a security incident, an accident, a fuel shortage, illness of a driver, a lawful order of a public authority, and a failure of utilities. We will tell you when we can and will try to complete or rearrange the shipment.

Drivers and other carriers

Kojora may use its own driver and vehicle or arrange another competent driver or carrier for the confirmed job. Kojora remains responsible to you on these conditions unless the confirmation names another carrier as the party you contract with.

Your responsibility to Kojora

You will meet a claim, loss, or cost that Kojora suffers because the goods were unlawful, wrongly described, or unsafely packed, or because you or the receiver failed to do what these conditions require. This does not apply to the extent the loss was caused by Kojora’s negligence, fraud, or wilful misconduct.

Law and disputes

These conditions are governed by the laws of the Federal Republic of Nigeria. The courts of Nigeria can hear a dispute. A consumer keeps any right to sue or complain in a forum the law allows.

If a court holds that part of these conditions is unenforceable, the rest stays in force. A failure to enforce a term once is not a waiver of it.
